Subscriber Terms
Last updated: 2026-09-10. These terms supplement the Terms of Service for consumer organizations.
Capital Enesti Inc. ("the Marketplace") operates apimercado.com, where you ("you") enable Access to APIs published by independent third-party providers ("Providers") and call them through the Marketplace gateway with your Keys. The Marketplace is not the provider of any API listed here.
By enabling Access or topping up your organization's balance, you acknowledge and agree that:
- The Marketplace is the merchant of record. You buy prepaid dollars from us. Payments for top-ups are made to the Marketplace, not to the Provider. We handle billing, tax at purchase, and Refunds of your balance.
- Your balances. At the start of each Month your organization receives a Free buffer of free dollars, spent before any prepaid dollars. A top-up adds a Grant to your Top-up balance; each Grant opens a Lot that expires 18 months after purchase. At Expiry the unspent remainder of a Lot is removed. Spend consumes the Lot expiring soonest first. You can see your Available balance and each Lot's expiry date on the Billing page.
- Top-up balances are not refundable. They are not refundable, except through a Dispute under clause 8 or a Refund or Adjustment we record at our discretion (for example, after Stripe reverses a payment). Unspent balances have no cash value outside the Marketplace and earn no interest.
- What a request costs. The Provider sets the Price. Each charged request costs the Price plus a fixed per-request Platform fee. When you top up, a Platform fee (currently 10%) is added to the amount you buy and shown on your invoice. All amounts are in US dollars. Prices exclude tax. Where we are registered to collect tax (for example GST or HST in Canada, or VAT in the EU or the UK), tax is added when you top up.
- Access is instant. Enabling an API needs no approval, and disabling it stops new Spend. Enabling and disabling do not entitle you to a Refund of your balance. A Key may carry an optional Spend cap limiting its Spend per Month.
- The Provider runs the API. The Provider is solely responsible for its API, its data, its availability, its support, and the lawfulness of what it offers. We provide discovery and gateway routing only.
- Your data. Requests sent through a Key are delivered to the Provider's systems. The Provider's privacy practices govern that data; review the Provider's documentation before sending sensitive information.
- Disputes. You can report a charged Request record as a Dispute within 30 days of the request. We investigate and decide each Dispute. A Dispute we uphold produces a Refund: the disputed Cost returns to your Top-up balance. Disputes, Refunds, and Deductions are described in the Terms of Service.
